Legally binding terms of use for the HALP network of property and business directory platforms.

TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using our websites, platforms, or services (including www.halp.com.au and www.boutiquedevelopments.com.au), you agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years of age. We may modify these Terms at any time; continued use constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms. We facilitate connections between property seekers and providers — we are not a real estate agent, developer, builder, or financial advisor. Property listing inquiries go directly to the listing advertiser (not stored by HALP). Platform inquiries via Contact Us, Join Us, or Advertise With Us forms are managed by HALP in Pipedrive, ActiveCampaign and Google Drive as described in our Privacy Policy.

3. User Accounts and Registration

Provide accurate information. Maintain the confidentiality of your credentials. You are responsible for all activity under your account. We may suspend accounts for breach, fraud, or non-payment. Contact support@halp.com.au to terminate your account.

4. User Conduct and Prohibited Activities

You must comply with all applicable laws. Do not: use unauthorized automated systems; interfere with our platform; post false, misleading or harmful content; impersonate others; engage in fraud, harassment, or discrimination; scrape or resell our services. Violations may result in suspension, termination, legal action, or reporting to authorities.

5. Property Listings and Information

Third-party listings are owned by developers, builders and agents. Property information, prices and school-zone data may change without notice. Always verify critical details directly with the provider, the school and the relevant education department before making a decision. We disclaim all warranties on listing accuracy, availability, or fitness.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN and comply with all applicable laws. Listings must be accurate and not misleading. Free and premium subscription tiers apply. Advertisers are responsible for how they handle inquiries and must comply with privacy and consumer laws.

7. Payment Terms (Advertiser Subscriptions)

Fees are in AUD, exclusive of GST unless stated. Standard payment processing fees are included in the advertised price unless stated at checkout. Payments are processed by Stripe (PCI-DSS Level 1). Subscriptions auto-renew; cancel anytime before the next billing date (no refunds for unused time). Pricing may change with 30 days' notice. Pro-rata refunds apply for technical outages preventing access.

8. Intellectual Property Rights

All platform content is owned by HALP or licensed to us and is protected by copyright, trademark and other IP laws. You are granted a limited, non-exclusive, revocable licence to use our services for personal, non-commercial purposes. You retain ownership of your submitted content but grant us a worldwide licence to use, display and adapt it in connection with our services. Report copyright infringement to legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, legal, tax or investment advice. Calculators and tools provide estimates only. We are not licensed real estate agents and do not guarantee investment returns. We do not control third-party conduct or content. Information may contain errors or be outdated. Services are provided "as is" and we do not guarantee continuous availability. Our infrastructure depends on AWS, Stripe, Pipedrive, ActiveCampaign, Google Workspace and other third-party providers.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, incidental, consequential or special damages. Where liability cannot be excluded, our total liability is capped at $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount paid in the prior 12 months. Nothing excludes non-excludable Australian Consumer Law rights. You agree to indemnify HALP for claims arising from your breach or misuse.

11. Dispute Resolution

Before legal action, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive NSW jurisdiction. Optional arbitration is available under ADRA rules in Sydney. Class actions are waived to the extent permitted by law. Injunctive relief may be sought in court for IP, confidentiality or irreparable harm matters.

12. General Provisions

These Terms, our Privacy Policy and any Listing Agreement form the entire agreement. Invalid provisions are severable. No waiver by non-enforcement. 13. Special Service Terms

Mortgage calculators provide estimates only, not pre-approvals. School zone data is aggregated from public sources and subject to change — verify with the school and education department. Property alerts require consent to email/SMS; modify or cancel anytime. Home loan referrals may involve fees; brokers are independent third parties.

15. Definitions

"Platform" — all HALP websites and apps. "User" — anyone accessing our services. "Content" — all materials on our platforms. "Property Provider" — developers, builders, agents. "Advertiser" — businesses in our directory. "Personal Information" — as defined in the Privacy Act 1988.
